마약류관리에관한법률위반(대마)
A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is not a person handling narcotics.
1. Purchasing marijuana;
A. On April 2014, the Defendant: (a) taken about KRW 14g of the hemp plant from a person who was unable to know his/her name on the road near the Mapo-gu Hongdong University, Mapo-gu, Seoul; and (b) delivered KRW 500,000 in return.
Accordingly, the defendant purchased marijuana.
B. Around November 2014, the Defendant: (a) taken about about 84g of the hemp plant from a person who was unable to know his/her name on the roads near the Gohap-dong, Mapo-gu, Seoul; and (b) delivered KRW 4 million in return.
Accordingly, the defendant purchased marijuana.
C. Around February 2015, the Defendant: (a) received approximately 84g of the hemp plant from a person whose name is unknown on the road near the said combined stations; and (b) delivered KRW 4 million in return, from a person whose name is unknown.
Accordingly, the Defendant purchased marijuana. D.
around May 16, 2015, the Defendant: (a) received approximately 84g g of the hemp plant from a person whose name is unknown; and (b) delivered KRW 2.5 million in return, from a person whose name is unknown.
Accordingly, the defendant purchased marijuana.
2. Sale of marijuana;
A. On June 17, 2015, the Defendant: (a) around 21:17, 2015, parked on the road near the Gangnam-gu Seo-dong Elementary School, Gangnam-gu, Seoul; (b) 1g of marijuana to E, and received approximately 100,000 won in return.
Accordingly, the defendant sold marijuana.
B. On July 11, 2015, the Defendant parked in a place not exceeding the Seoul Gangnam-gu Seo-dong, Gangnam-gu, Seoul, where it is unknown to view the place, and 1g of marijuana to said E in the above benz’s car, and received KRW 100,000 in return.
Accordingly, the defendant sold marijuana.
C. On April 1, 2015, the Defendant, around 16:00, sold approximately KRW 300,000,000 to F (one person, G), a total of KRW 118.5ggs of marijuana over 23 times from July 22, 2015, as indicated in the list of crimes in the attached Table, to F (one person, one), and three hundred thousand won in return, on the road near active duty service.
Accordingly, the defendant is a hemp.
