Punishment of the crime
The Defendant, as the representative of Yongsan-gu Seoul Metropolitan Government building B and D, is an employer who conducts a service business (a summary and a written test) by using eight full-time workers.
1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.
Nevertheless, the Defendant did not pay KRW 11,937,264 of the total wages of two workers, including KRW 1,230,000 on October 9, 2017, when he/she worked from May 9, 2016 to December 29, 2017, within 14 days from the date of retirement, which is the date of the occurrence of the cause for payment, without agreement between the parties to the extension of the due date.
2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after any cause for such payment occurred; and
Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.
Nevertheless, the Defendant did not pay the total amount of KRW 14,346,316 of the retirement allowances of two workers, including KRW 3,878,136 of E retirement allowances, which served from May 9, 2016 to December 29, 2017, within 14 days from the date of retirement, which is the date of the occurrence of the cause for payment, without an agreement between the parties on the extension of the due date.
