The prosecution of this case is dismissed.

Reasons

1. 공소사실 피고인은 2016. 11. 25. 04:10 경 경주시 B 아파트 103동 205호 피고인의 주거지에서, 술에 취하여 잠을 자고 있던 피고인의 부( 父) 인 피해자 C(58 세 )를 깨워 이야기를 하자고 하였는데 피해자가 거절을 하였다는 이유로 화가 나 주먹으로 피해자의 머리를 수회 때리고, 발로 피해자의 목 부분을 수회 걷어찼다.

Accordingly, the defendant assaulted his lineal ascendant or descendant victim.

2. Determination

(a) Crimes of non-violation of intention (Article 260(3) and (2) of the Criminal Act);

B. The victim expressed his intention not to punish him after the indictment of this case

C. Judgment dismissing public prosecution (Article 327 subparag. 6 of the Criminal Procedure Act)
