2. We agree with the prosecutor's arguments that the crime committed against the police officer is heavy. However, in full view of the circumstances and other conditions of sentencing under Article 51 of the Criminal Act, the court below's sentencing is acceptable, and there is no unreasonable ground for the prosecutor's assertion.

3. In conclusion, the prosecutor's appeal is dismissed without pleading pursuant to Article 364 (5) of the Criminal Procedure Act, since it is obvious that the prosecutor's appeal is groundless. It is so decided as per Disposition.
