The judgment of the court below is reversed.

Reasons

1. The summary of the grounds for appeal (the factual error) was the fact that the Defendant was playing out at the time of the instant accident, and the court testified in accordance with his memory, and the judgment of the court below which convicted the Defendant of perjury is erroneous in misunderstanding of facts.
