In full view of the following circumstances: (a) the Defendant, without any special reason, abused the victim and did not make any effort to recover damage up to the trial; (b) the victim wanted to punish the Defendant; and (c) the Defendant has been punished several times for the same kind of crime; and (d) the Defendant has been punished several times for the same crime; and (b) the sentence of the lower court appears to be appropriate; and (c) the Defendant’s assertion is rejected.

3. Accordingly, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is groundless. It is so decided as per Disposition.
