A. From January 31, 2012 to May 2015, the Plaintiff, a corporation established for wholesale business, etc. of construction materials, supplied Defendant B Co., Ltd. (hereinafter “Defendant Company”) with air-conditioning parts equivalent to the sum of KRW 3,880,183,823 (hereinafter “instant goods”). From March 15, 2012 to April 29, 2015, the Defendant Company paid KRW 3,03,94,882 to the Plaintiff as the price of the instant goods.

B. Meanwhile, the defendant company is above the defendant company.

30,943,710 won out of the amount of goods paid to the Plaintiff as described in the subsection (a) is paid by the Defendant Company by cultivating the Plaintiff the electronic bill endorsed from the Aard System Co., Ltd. (hereinafter “Aard System”), as indicated in the table on the cultivation and transfer of electronic bills.

C. On October 1, 2014, Defendant Company transferred to the Plaintiff the claim amounting to KRW 538,580,710 for the installation of air conditioners with respect to the ID system of Defendant Company (hereinafter “the claim for the instant construction cost”) and notified the transfer of the said claim to the AD System on the same day.

2. Determination as to the claim against the defendant company

A. According to the above facts, the defendant company is obligated to pay 846,188,941 won (=3,880,183,823 won) payable to the plaintiff, barring special circumstances, and delay damages therefrom (3,03,94,882 won, as the plaintiff is the person of 3,033,94,82 won).

B. First of all, the Defendant Company asserted that the Defendant Company’s claim for the instant construction payment amounting to KRW 538,580,710 against the ID system of the Defendant Company was transferred to the Plaintiff in lieu of the repayment of the instant goods payment obligation, and that the instant goods payment obligation expires within the scope of KRW 538,580,710.

In this regard, the obligor has performed his obligation to the obligee.
