A person who intends to divert farmland shall obtain permission from the Minister of Agriculture, Forestry and Food Affairs after obtaining confirmation from the Farmland Management Committee having jurisdiction over the location of the farmland, as prescribed by Presidential Decree.

Nevertheless, the Defendant performed farmland diversion activities without obtaining permission on farmland diversion in February to March, 2012, by making brine-gun C, D, E farmland 1,674 square meters.
