1. The Defendant’s KRW 75,091,418 as well as the Plaintiff’s KRW 6% per annum from May 1, 2018 to May 14, 2018.
1. The Plaintiff was employed as an employee of the Defendant from January 16, 2008 to April 30, 2018. However, the Plaintiff was not paid total of KRW 33,445,120 on the ground that he/she was paid KRW 8.2 million for August, 2015; KRW 8.2 million for September, 2015; KRW 6.6 million for May, 2017; KRW 4 million for March, 2018; KRW 4 million for March, 2018; KRW 4,895,630 for February, 20; and KRW 4,349,49, and KRW 490 for April, 2018.
Furthermore, the Plaintiff did not receive retirement allowances from the Defendant. The Defendant is obligated to pay to the Plaintiff the total amount of KRW 75,091,418 (=3,445,120 won) and damages for delay calculated at the rate of 6% per annum under the Commercial Act from May 1, 2018 to May 14, 2018, which is the following day after the retirement date of the Plaintiff, from May 14, 2018, from May 14, 2018, from the following day to the date of full payment, to the date of full payment, to the amount of KRW 20% per annum under Article 37 of the Labor Standards Act, Article 17 of the Enforcement Decree of the Labor Standards Act.
