피고인은 2014. 9. 22. 18:00경 대구 수성구 C건물 1101동 807호 피고인의 주거지에서 정수기 점검을 하기 위해 방문한 D 정수기 동대구지점 소속 플래너인 피해자 E(여, 51세)을 강제추행할 마음을 먹고, 정수기를 교체하겠다며 설명을 요구한 후 피해자로부터 명함을 건네받자 “E씨 영업 잘 하겠다.”라고 말하며 손으로 피해자의 왼쪽 가슴을 1회 툭 치고, 이에 피해자가 “잘못 치신거죠.”라고 말한 후 계약에 대한 설명을 마치자 “계약도 했는데 데이트 한번 하자.”고 말하고, 이후 현관 쪽으로 걸어나가는 피해자의 뒤로 접근하여 오른손으로 피해자의 오른쪽 가슴을 만지고 왼손으로 피해자의 성기 부분을 만지는 등 피해자를 강제추행하였다.
