1. The Defendants deliver to the Plaintiff each of the relevant real estate listed in the separate sheet.

2. The costs of lawsuit are assessed against the Defendants.

Reasons

1. Basic facts

A. The Plaintiff is a housing redevelopment and rearrangement project association established to implement a housing redevelopment and rearrangement project by making the housing redevelopment and rearrangement project district (hereinafter “project implementation district of this case”) with the land size of 40,404m2 in Gyeyang-gu, Yangyang-gu, Yangyang-gu as the project implementation district of this case. The Defendants are the owners of each relevant real estate listed in the attached Table in the project implementation district of this case.

B. (1) The Governor of the Gyeonggi-do, in order to promote the balanced development of new and old cities, comprehensively and efficiently planning, and promoting the improvement of the residential environment, the expansion of infrastructure, and the recovery of urban functions in underdeveloped areas on November 5, 2007, the Gyeonggi-do Governor designated the area of 805,789 square meters in Goyang-si, Goyang-si as an urban renewal acceleration district pursuant to Article 5(1) of the former Special Act on the Promotion of Urban Renewal (amended by Act No. 10761, May 30, 201; hereinafter “former Urban Renewal Act”), as an urban renewal acceleration district pursuant to Article 5(1) of the former Special Act on the Promotion of Urban Renewal (hereinafter “former Urban Renewal Act”).

(2) On February 13, 2010, Yangyang City established an urban renewal acceleration plan on the K urban renewal acceleration district and applied for the determination of the urban renewal acceleration plan to the Governor of the Gyeonggi-do on February 13, 2010, and on July 29, 2010, the Governor of the Gyeonggi-do publicly announced by the Gyeonggi-do on July 29, 2010, the Governor of the Gyeonggi-do, as well as publicly announced the determination of the urban renewal acceleration plan containing the details, etc. of designating N and O areas (N areas correspond to the Plaintiff’s project implementation district) as the urban renewal acceleration district for the housing redevelopment project, including the contents, etc. of the urban renewal acceleration plan that expands the area of the previously designated urban renewal acceleration district from 805,789 square meters to 843

(3) The Gyeonggi-do Governor has reached the ratio of old and inferior buildings A to 51.1% (45-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong), while making the instant promotion plan determination.
