1. The Defendants are jointly and severally and severally liable to the Plaintiff for KRW 58,617,352 and KRW 58,046,404 among them, from October 14, 2016.
According to the overall purport of Gap evidence Nos. 1 through 6 (including the provisional number), the plaintiff extended a loan of KRW 130,595,500 to defendant A on May 10, 2016 with a loan period of KRW 130,595,50 per annum and a delayed interest rate of KRW 24% per annum under the joint and several guarantee of defendant B, and the subsequent repayment of the loan was delayed, and on October 13, 2016, the loan amount of KRW 58,046,404 as of October 13, 2016 and delay damages amount of KRW 570,948.
According to the above facts of recognition, the defendants are jointly and severally liable to pay to the plaintiff 58,617,352 won (i.e., loans of KRW 58,046,404 and damages for delay of KRW 570,948) and damages for delay calculated at the rate of 24% per annum, which is the interest rate for delay from October 14, 2016 to the date of full payment.
Thus, the plaintiff's claim against the defendants is justified, and all of them are accepted.
