The plaintiff's successor's claims are all dismissed.
Of the litigation costs, the plaintiff and the defendant have arisen.
1. Basic facts
A. The Defendant, as a school juristic person operating D University, owned the land in the project site of a housing redevelopment project for removing previous buildings and constructing apartment and neighborhood living facilities. The Plaintiff’s successor acquired the ownership by winning a successful bid in the real estate compulsory sale procedure.
B. On January 16, 1987, during the implementation of the said redevelopment project, the non-party partnership agreed to the Defendant to substitute and relocate the site located in the school regularly operated by the Defendant among the said redevelopment project site to the Defendant. On February 1, 1988 and October 1992, the non-party partnership acquired the land of 113 square meters in Seodaemun-gu Seoul as at the time of the lot number among the said redevelopment project site and completed the registration of the transfer of ownership in the name of the non-party partnership by acquiring the land of 164 square meters in Seoul as at the time of expropriation or sale on the ground of the expropriation ruling or sale.
C. On April 28, 2005, the non-party union was to complete the above redevelopment project and entered into a sales contract with the Defendant to sell the land to the Defendant in full condition that is not limited by provisional attachment, attachment, provisional disposition, or limited real right and to complete the registration for transfer of ownership immediately after the transfer of ownership is completed on December 9, 2005, with the same content as the above sales contract, on December 9, 2005, in a lawsuit filed by the Defendant against the non-party union for the registration of transfer of ownership on the land subject to sale, including the land of this case, which is 609 square meters in total or in total for nine parcels, including the land of this case, which is 609 square meters in size under the above redevelopment project.
