1. Basic facts
A. On September 17, 2009, Defendant A entered into an insurance contract with the Plaintiff and the insured and the beneficiary of the survival insurance as Defendant A (hereinafter “instant insurance contract”) and changed the policyholder of the instant insurance contract and the beneficiary of the survival insurance to Defendant B on November 24, 2009.
The insurance contract of this case contains a special agreement that guarantees the daily allowance of 30,000 won per day when the insured is hospitalized by disease.
B. After entering into the instant insurance contract, Defendant A was hospitalized for five days from January 22, 2010 to January 26, 2010 due to the diagnosis of the 4-5th anniversary of the date of the conclusion of the instant insurance contract, including the fact that he/she was hospitalized for five days from the same day, and the fact that he/she was hospitalized for five days from January 26, 2010, as indicated in the following table, from January 22, 2010 to September 3, 2014, on 39 occasions in total as indicated in the following table: light signboards, other conical signboards, such as protruding signboards, other protruding signboards, disability, debrising symptoms, hump, spinebrate accompanied by the chronic ppuri disease, and other conical signboards, hump cards, kneump, kne-free symptoms, debrising symptoms, debrising symptoms, and detailed debrising symptoms, fluoring, conical signboards, etc.
