A defendant shall be punished by imprisonment for not less than one year and six months.
10,818,00 won shall be additionally collected from the defendant.
Punishment of the crime
On June 9, 2011, the Defendant sentenced 10 months to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at the Seoul Central District Court on September 2, 2011, and completed the execution of the sentence on September 2, 201.
The defendant is not a person handling narcotics.
1. Possession of penphones;
A. At around 18:00 on August 13, 2012, the Defendant: (a) carried approximately 5g of psychotropic drugs, which are psychotropic drugs, located in vinyl bars, at the guest room of 306 located in the Gyeonggi-gu Suwon-si, Gyeonggi-si, the Defendant carried approximately 3g of bitampon (hereinafter “copon”).
B. At around 23:00 on August 19, 2012, the Defendant: (a) carried approximately 1.3g of philopon, which was divided into two near the roads of the E office located in the Dong-gu, Ho-gu, Gyeonggi-si; and (b) carried approximately 1.3g of philopon in the color hand room.
2. Purchasing phiphones;
A. On August 22, 2012, the Defendant asked F to the effect that F can purchase a penphone from G, and F accepted it.
F on August 23, 2012, at around 14:00, the G purchased approximately KRW 0.7g of philopon, which was 0.7g from G, for a disposable injection machine in the vicinity of the H station near the Gyeonggi-si Government on August 23, 2012, and at around 22:00 on the same day, the Defendant 0.7g of the said philopon from the cross-discopon guest room in the Gyeonggi-si Si.
On August 23, 2012, at around 22:00, the Defendant issued F with a purchase price of 300,000 squarephones to F, and transferred KRW 400,000,000 from the account of the Agricultural Cooperative Federation (I) in the name of the Defendant to the account of F’s community credit cooperatives (J) around August 24, 2012.
Accordingly, the Defendant purchased approximately KRW 0.7g of 0.7g of philophones from G through F’s arrangement.
B. On September 3, 2012, from around 17:05 to 17:07 of the same day, the Defendant received 3.5 million won from K to the national bank account (Account Number: L) in the name of the Defendant, and received 3.5 million won from the national bank from around 17:07 to July 09 of the same day.
