A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is not a person handling narcotics who belongs to two groups of U.S. nationality in Korea.
1. The Defendant, in collusion with D, purchased narcotics at the pharmacy, sold them to the U.S. military and other foreigners, and decided to appropriate them for living expenses.
On June 15, 2012, the Defendant, in collusion with D, presented a forged prescription for the pentcoon component of the pentcoon as if his name was F and as if he was determined by the doctor, and presented a prescription for purchase of 180 g of the pentine solution (40mg) containing narcotics, to a pharmacy located within the above hospital, and D purchased the 180 m of the above pentcoon solution by paying medical expenses, preparation fees, etc.
Accordingly, the defendant, in collusion with D, possessed narcotics.
B. On June 25, 2012, the Defendant, in collusion with D on June 25, 2012, presented a forged prescription for the composition of the pentcoon as if his name was F, and as if he was the patient with whom a doctor prescribed a flat drug, issued a prescription for purchasing 180 square meters of the pentcoon book (40mg) containing narcotics, and presented it to the pharmacy located within the said hospital, and D purchased the 180 pentcoon book book by paying medical expenses, preparation fees, etc.
Accordingly, the defendant, in collusion with D, possessed narcotics.
2. The Defendant, in collusion with D, did not find a pharmacy dealing with the issue of a prescription by which H was issued to purchase nicotine solution, and did not find a pharmacy to deal with the issue. The Defendant introduced a pharmacy to handle the above H’s nicotine solution, received a partial delivery of the nicotine solution from H, and sold it to foreigners such as the U.S. military, etc., and determined that it would be allocated for living expenses.
