Reasons

1. Basic facts

A. The Plaintiff is a person who completed the registration of ownership transfer on March 24, 2014 with respect to a building D (hereinafter “instant building”) on the ground of 1,117 square meters in Busan Shipping Daegu C, Busan Metropolitan City (hereinafter “instant building”). The Defendant is a person who operates a parking lot in the parking lot indicated in the attached list in the instant building (hereinafter “instant parking lot”).

B. (1) The Defendant, in accordance with the parking lot lease agreement with E and F, who was operating the instant parking lot in accordance with the instant parking lot lease agreement with E and E (hereinafter “stock company’s name is omitted; hereinafter the same shall apply) and paid KRW 130 million as premium. On August 16, 2010, the Defendant newly concluded a lease agreement with E and F, which was for KRW 100,000 per month, under the name of E and E, who was operating the instant parking lot, for the purpose of paying KRW 100,000,000 as premium. On August 16, 2010, the lease agreement was newly concluded with E and E, which is for KRW 100,000 per month, management expenses, repair and maintenance expenses, repair and maintenance expenses, and depreciation expenses (hereinafter “management expenses, etc.”).

Article 2 of the contract for the lease of a parking lot / [Renewal of Rental Deposit] The lessee shall pay 100 million won to the lessor as interest-free, but the previous lease deposit shall be substituted by the interest-free deposit.

Article 3 (Management Expenses, etc.) The amount of KRW 1 million per month shall be determined as management expenses, etc. for parking lots, and the lessee shall deposit the management expenses for the preceding month into the following account designated by the lessor on the fifth of each month.

(Ma) Article 4 / [Period of Contract] This Agreement is for two years from August 16, 2012 to August 15, 2014.

Provided, That if there is no objection between both parties at least three months prior to the expiration of the period, the period shall be extended under the same condition.

Article 5 (Prohibition of Transfer, etc. of Right of Lease) The lessee shall transfer the right of lease to another person, sub-lease or have another person use it without the consent of the lessor.
