A. The Plaintiff (Appointed Party; hereinafter referred to as the “Plaintiff”) and the designated parties have owned or owned the land indicated in the attached Table 2 “Land Ownership” list (hereinafter referred to as “instant land”) during the period indicated in the “The Claim List for Unjust Enrichment” in attached Table 3.

The defendant is a construction project aimed at the power generation, transmission, distribution, and business related thereto.

B. The instant land does not pass through a special high voltage processing and distribution line installed by the Defendant prior to 1990 (hereinafter “instant electric cable”) in a space inside and outside 10 meters high from the ground.

The instant electric wire is a device that automatically cut off from electric lines within 2 seconds from the time of the occurrence of multiple-line knowledges.

C. According to Article 118 of the “Standards for Electric Equipment Technology” (amended by the Ministry of Trade, Industry and Energy No. 1993-70 of September 3, 1993, and thereafter several times), special high-tension electric wires (the special high-tension electric wires of at least 22,90 V are classified as special high-tensions) with the use voltage of at least 22,90 V (the special high-tension is classified as at least 7,00 V) are installed on the ground surface at a height of at least 8 meters. According to Article 140(1)3 of the “Standards for Electric Equipment Technology” (the special high-tension electric wires and structures with the voltage of at least 35,00 V) are the separation distance between the steering materials of upper tier (the roof, pent, clothesing, or any other lighting materials which are likely to go up by people).

On the other hand, according to Article 150 (4) 2 of the above standard, only a smoke-driven cable with an automatic voltage exceeding 15,000 V and below 25,00 V is a special high voltage cable, which is equipped with a device to automatically block the power generation within 2 seconds from the time of the electric power generation, as a knowledge of neutical multi-ray contact, notwithstanding the above provision.
