The prosecution of this case is dismissed.
Reasons
1. On June 21, 2017, the Defendant assaulted the victim’s face of the victim C (the victim, 42 years old) once, and the victim’s neck by hand at the victim’s seat at a small area within the 105 Dong Dong-gu, Ansan-si, 105 Dong 506, a residential area, on June 21, 2017.
2. Determination of the above facts charged is a crime falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent pursuant to Article 260(3) of the Criminal Act. Since the victim withdraws his/her wish to punish the defendant on July 20, 2017, which was after the prosecution, the prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
