1. The defendant is out of 100 m2,960 m2, 100 m2,000 m2,000 for the plaintiff succeeding intervenors.

Reasons

1. Facts of recognition;

A. In around 1997, the Plaintiff’s father I was registered as the owner of the land allotted in recompense for development outlay 4,960m2 (hereinafter “instant land secured by the recompense for development outlay”) in the ledger of the land secured by the Defendant Union for the development recompense managed by the Defendant Union.

B. On October 4, 2011, the Plaintiffs succeeded to the land allotted by the authorities in recompense for development outlay due to the death of the network I, and registered the land as the owner of the land allotted by the authorities in recompense for development outlay.

(Plaintiff A’s 3,625, Plaintiff B’s 1,322.5).

Meanwhile, on September 18, 2015, when the lawsuit of this case was pending, the Plaintiffs sold the land allotted by the authorities in recompense for development outlay to the Plaintiff’s succeeding intervenors, and on the same day, the Plaintiff’s succeeding intervenors were listed as the owner of the land allotted by the authorities in recompense for development outlay, such as the Plaintiff’s shareholding ratio.

피고는 이 사건 체비지 중 별지 도면 표시 3, 4, 5, 6, 7, 8, 13, 14, 15, 16, 17, 18, 19, 3의 각 점을 차례로 연결한 선내 ㈁ 부분 3,062㎡ 지상을 건축자재 야적 및 주차장으로 사용하고 있으며, 별지 도면 표시 20, 5, 6, 7, 21, 20의 각 점을 차례로 연결한 선내 ㈂ 부분 151㎡와 별지 도면 표시 22, 23, 24, 25, 22의 각 점을 차례로 연결한 선내 ㈃ 부분 144㎡ 지상에 각 판넬구조건물을 사무실로 사용하고 있고, 별지 도면 표시 26, 27, 28, 29, 26의 각 점을 차례로 연결한 선내 ㈄ 부분 지상 16㎡에 개집을, 별지 도면 표시 30, 31, 32, 33, 30의 각 점을 차례로 연결한 선내 ㈅ 부분 지상 18㎡ 컨테이너를 각 설치하여 두는 등 이 사건 토지를 점유하고 있다
