1. The Defendants, respectively, shall make on April 12, 2010 with respect to each of 1/3 shares of 1,504 square meters, among the 1,504 square meters in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do.
1. The following facts do not conflict between the parties, or each entry of Gap evidence Nos. 1-2, 2, 3, 3, 4, 5-2, 3, 6, 8, and 4-2, 3, 6, and 8-4, and the result of the on-site verification conducted by this court, may be acknowledged by taking into account the overall purport of arguments and arguments:
On September 10, 1917, the G land of Chungcheongnam-gun was assessed against H.
On November 4, 1929, the said land became subject to registration conversion with the area of 1,504 square meters (hereinafter “instant land”).
B. The Defendants, the grandchildren of H, respectively, completed the registration of initial ownership on March 3, 2010 by the Daejeon District Court’s Branch Office of Registry of the Daejeon District Court as to each of the shares of 1/3 of the instant land.
C. Of the instant land, the Plaintiff’s residential housing (hereinafter “instant housing”) is located on the ground of the part (e) of 28 square meters in the ship connected each point of 28,29, 30, 31, and 28, among the instant land, each point of (c) part 15 square meters in the ship connecting each point of 32, 33, 34, 35, and 32 attached Table No. 32, 32, 34, 35, and 32, and each point of (d) part 72 square meters in the ship, attached appraisal map No. 36, 37, 38, 39, and 36, connected each point of 28 square meters in sequence, and the attached appraisal sheet No. 1,25,26, 27, 18, 19, 20, 21, 222, 23, 24, and 1.
The instant housing was newly built in 1945 and completed the first ownership registration.
The plaintiff married with I on March 5, 1954, and I died on April 12, 1990, and the plaintiff inherited the house of this case and continued to reside in the house of this case since that time.
E. Meanwhile, the land adjacent to the instant land is registered for transfer of ownership on the ground of sale on May 1, 1950 pursuant to the Act on Special Measures for the Registration, etc. of Ownership of General Farmland (amended by Act No. 1657, Sep. 17, 1964; hereinafter “Special Measures Act”).
