The prosecution of this case is dismissed.
Reasons
1. The Defendant, at around 14:50 on August 14, 2019, committed an assault on the victim’s face on the hand floor on the ground that the victim did not receive the Defendant’s death, on the ground that the victim did not receive the Defendant’s death. At the third floor of the Silung branch, the Defendant was assaulted at one time on the face of the victim.
2. The offense of assault can not be prosecuted against the victim’s express intent (Article 260(3) of the Criminal Act). Since the victim expressed his/her intention not to prosecute the defendant after instituting the prosecution, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
