A defendant shall be punished by imprisonment for a period of four months and a fine of one million won.
When the defendant does not pay the above fine.
Punishment of the crime
On June 21, 2016, the Defendant was sentenced to imprisonment with labor for a violation of the Act on Special Cases concerning the Settlement of Traffic Accidents, etc. at the Busan District Court on June 18, 2017, and completed the execution of the sentence in Busan Detention Center on June 18, 2017.
In addition, on April 22, 2009, the defendant was sentenced to six months of imprisonment by the same court due to a violation of the Road Traffic Act (drinking driving), and on September 27, 2017, the decision became final and conclusive on October 11, 2017 after being sentenced to one year of imprisonment and fine of three hundred thousand won due to a violation of the Road Traffic Act (dacting driving) at the Busan District Court Branch Branch Branch Branch.
[Criminal facts]
1. A crime committed on July 28, 2017;
A. Notwithstanding the fact that the Defendant violated the Road Traffic Act (drinking driving) and the Road Traffic Act (Dless driving) at least twice as a crime of violating the Road Traffic Act (drinking driving), the Defendant driven an automobile dedicated to the disabled person with no license plate in the state of alcohol leveling 0.173% of alcohol level during the blood, without obtaining a bicycle license, from the 1k section of approximately 1k to the front of the 144-lane from the 140-ro Don-gu, Busan, Spo-gu, Busan, as of July 28, 2017 to the front of the 144-lane.
(b) No person who violates the Guarantee of Automobile Compensation shall operate any motor vehicle which is not covered by mandatory insurance;
Nevertheless, the defendant operated the above Oral Ba which was not covered by mandatory insurance at the time and place mentioned in Paragraph 1-A above.
2. A crime committed on July 28, 2017;
A. Although the Defendant violated the Road Traffic Act (drinking driving) and the Road Traffic Act (Dless driving) committed a violation of the Road Traffic Act (drinking driving) more than twice, the Defendant only used a disabled person with no license plate while under influence of 0.136% of alcohol in the blood alcohol level without obtaining a bicycle license at approximately 300 meters from the Defendant’s dwelling place located in Busan Spo-gu C around July 28, 2017 to D. < Amended by Act No. 14835, Jul. 26, 2017>
