1. 상해 피고인은 2013. 6. 11. 03:00경 대구 중구 Z에 있는 성매매업소 K 3호 앞 도로에서 업소 아가씨 3명에게 “씨발년들아 3호집 장사 그만하고 싶나 이카다 다 뒤진다 똑바로 해라 알았나”라며 욕설을 하며 행패를 부리고 있던 중, 그곳을 지나가던 피해자 AA(29세)이 피고인에게 “동네 왜 이렇게 시끄럽게 하노, 좀 조용하지”라고 말을 하자 이에 화가 나 피해자에게 달려와 이마로 피해자의 얼굴을 들이받아 바닥에 넘어뜨린 후 “야이 씨발 새끼야, 니 방금 뭐라 캤어, 니 어느 동네야 새끼야, 내가 누군지 아나, 히야가 이 동네에서는 일등이다”라고 욕설을 하며 주먹과 발로 피해자의 얼굴 등을 수 회 때려 피해자에게 약 2주간의 치료를 요하는 상악 부위 열린 상처 등의 상해를 가하였다.
