Reasons

The summary of the facts charged of this case is that the defendant committed assault against AD, such as pricing the face of AD, and this is a crime falling under Article 260 (1) of the Criminal Act and cannot be prosecuted against the victim's express intent under Article 260 (3) of the Criminal Act. According to the statement of the written application for non-prosecution of punishment bound in the records, AD has been recognized on January 31, 2013, which is the date of the prosecution of this case, and therefore, AD has expressed its intention not to be punished against the defendant.
