1. On April 20, 2009, C, the owner of Seosan-gu Dang 403, was notified of the decision of compulsory commencement of the auction (E) on the above real estate on April 20, 200, the Defendant who leased the above No. 403 as monthly rent of KRW 3 million and F, along with F, the purport that “C leases the above No. 403 on March 30, 2008 to F, the lease deposit of KRW 18 million.” The C, the owner of Seosan-gu Dang 403, the Korea Technology Credit Guarantee Fund, by deceiving the court by submitting the above lease contract to the court, acquired dividends to be received by the victim and conspired to divide them.

Based on the above public offering, the facts of the defendant, C, and F at H offices operated by the defendant in Suwon-si, Gyeonggi-gu, Gyeonggi-do, G around April 2009 are as follows: C received KRW 18 million from F and leased KRW 403 of the lease deposit to F; and C prepared a lease contract stating that "C leases KRW 403 of the lease deposit to F with KRW 18 million on March 30, 2008," and then submitted the above lease contract to a worker whose name the execution and name of Ansan-gu branch court was not known.

As a result, the defendant, C, and F had the Suwon District Court enter the distribution schedule that, on December 29, 2009, F could distribute 14 million won and 422,551 won to F in the first order.

F On January 4, 2010, even though the Korea Technology Finance Corporation had continued to have filed a lawsuit of demurrer against distribution with respect to the said distribution schedule, the F made a telephone call to the J, which is an employee of the said Suwon District Court, for several times at that time, “I would find dividends because the lawsuit of demurrer against distribution has been terminated,” and received dividends of KRW 14,422,550 on March 19, 2010 and acquired the dividends of KRW 14,42,550.
