1. The Defendants are jointly and severally liable to the Plaintiff for 100,000,000 won and 8% per annum from June 1, 2014 to June 26, 2014.
No dispute exists between the parties, or comprehensively taking account of the purport of the entire pleadings in each statement in Gap evidence Nos. 1 through 4 (including the serial number), the Plaintiff loaned KRW 100,000,000 to Defendant B on September 30, 2013, KRW 50,000,000,000 on October 18, 2013, and KRW 15,000,000 on October 31, 2013 as the due date for repayment. The Defendants jointly and severally guaranteed Defendant B’s debt on June 23, 2014; the Defendants jointly and severally paid KRW 10,000,000 to the Plaintiff on March 20, 2015, the Defendants agreed to pay the interest accrued at the rate of KRW 100,000,000 to KRW 16,00,000 on June 18, 2015, respectively.
According to the above facts of recognition, the defendants are jointly and severally liable to pay 100 million won of the above borrowed money and 8% interest and delay damages calculated at the rate of 12% per annum from June 1, 2014 to June 26, 2014, and 12% per annum from the next day to the date of full payment.
Thus, the plaintiff's claim is justified, and all of them are accepted.
