1. The Defendant shall pay to the Plaintiff KRW 44,20,000 and the interest rate of KRW 15% per annum from December 21, 2016 to the date of full payment.
On July 8, 2016, the Defendant subcontracted the construction cost for “the installation of image equipment and installation of an experience lecture room” to the Plaintiff on the condition that the construction cost was KRW 125,40,000,000 in total. The Plaintiff completed the subcontracted construction work as above. The fact that the Defendant paid only KRW 81,20,000 to the Plaintiff out of the said construction cost does not conflict between the parties.
Therefore, barring any other special circumstances, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum from December 21, 2016 to the day of full payment, which is the day following the delivery of the original copy of the instant payment order, sought by the Plaintiff.
Therefore, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
