A. On January 8, 2013, the Plaintiff, as the owner of the real estate listed in the separate sheet (hereinafter “the instant real estate”). On January 8, 2013, the Plaintiff concluded a sales contract (hereinafter “the instant sales contract”) with Nonparty Empethyl Co., Ltd. and the instant real estate as the purchase price of KRW 350,000 (30,000,000 at the time of the payment contract, the first intermediate payment of KRW 100,000,000 on January 21, 2013, the second intermediate payment of KRW 100,000,000,000 on January 30, 2013, the payment date of KRW 120,000,000 on February 8, 2013).

B. In entering into the instant sales contract, the Plaintiff and Nonparty 2, while entering into the instant sales contract, set up a collateral on the part of Nonparty 2, which was designated by the Plaintiff to Nonparty 2 (hereinafter “BE”) and granted the right to collateral security to Nonparty 3 (hereinafter “BE”) (Article 1). Nonparty 2, Dong Young Esty Co., Ltd., in relation to the execution of the instant sales contract between the Plaintiff and Nonparty 2, is jointly and severally liable for Nonparty 2 and Nonparty 2, if Nonparty 2 is unable to make payment due to the nonperformance of the contract, and the instant sales contract is null and void at the time of cancelling the contract due to the nonperformance of the contract, and the registration of collateral security establishment is immediately cancelled.

C. On January 8, 2013, Nonparty 1 completed the registration of the establishment of a collateral security under the No. 9999, which was received on January 10, 2013, on the ground of the contract to establish a collateral security.

Nonparty 1 paid KRW 80,00,000 as part of the intermediate payment on January 8, 2013, and KRW 80,000,000 as part of the intermediate payment on April 19, 2013, but did not pay the remainder of KRW 240,00,000.

E. On November 18, 2013, the Plaintiff is Nonparty 1.
