Reasons
1. 공소사실 피고인은 2017. 6. 29. 21:50 경부터 다음날 15:47 경 사이 다음 사이트에 개설된 B 20 대 커뮤니티 'C '에 접속한 후 피해자 D을 지칭하며 " 백석 예대 다니는 D B 해요, D 너 턱 완전 커..( 백석 예대), D 아 너 턱 너무 커, 왕따라 맥 날에서 혼 밥하는 D, D 턱 잡고 동네한 바퀴 ㅎㅎ" 라는 글로 닉네임을 변경 하였다.
Accordingly, the defendant openly insultingd the victim.
2. The above crime is a crime subject to prosecution where a complaint is filed under Article 312(1) of the Criminal Act. The record reveals that on August 31, 2017, after the prosecution of this case, the victim submitted an agreement to the effect that the complaint is withdrawn, and thus, the prosecution of this case is dismissed in accordance with Article 327(5) of the Criminal Procedure Act.
