A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Punishment of the crime
1. Violation of the Act on the Control of Narcotics, etc. Due to Sale and purchase;
A. On January 22, 2014, at around 21:10, the Defendant contacted with B, who sells psychotropic drugs, via the Internet, transferred KRW 50,000 to the Daegu bank account in the name of C designated by B, as the purchase price for opon. On the same day, at around 21:30, the Defendant was issued with a method of finding 0.7g of opon which B concealed within the cash payment machine in Gangnam-gu Seoul Metropolitan Government, as notified by B at around 21:30 on the same day.
Accordingly, the Defendant traded psychotropic drugs.
B. On January 28, 2014, around 21:58, the Defendant wired KRW 500,000 to the above C’s account under the said C’s name as the purchase price for phiphones, and was issued 0.7g of phiphones by the said method at around 22:20 on the same day.
Accordingly, the Defendant traded psychotropic drugs.
2. Violation of the Act on the Control of Narcotics, etc. Due to medication;
A. At around 22:00 on January 22, 2014, the Defendant injected 0.05g of the philophones purchased from B in water, and injected them to the right arms using a disposable injection device, after dilutioning 0.05g of the philophones purchased from B.
B. At around 22:00 on January 24, 2014, the Defendant administered 0.05 g of phiphones in the aforementioned manner within 1406.
C. At around 22:00 on January 26, 2014, the Defendant administered 0.05g philophones in the aforementioned manner within 1406.
D. At around 22:00 on January 28, 2014, the Defendant administered 0.05g philophones by the aforementioned method within 1406.
E. At around 22:00 on January 30, 2014, the Defendant administered 0.05g philophones by the aforementioned method within 1406.
F. At around 22:00 on February 1, 2014, the Defendant administered 0.05 g of phiphones in the aforementioned manner within 1406.
G. On March 16, 2014, the Defendant: (a) around 21:00, within a telephone with which the name in the Songpa-gu Seoul Songpa-gu movement is unknown; and (b) 0.05g of phiphones from B.
