A. On June 28, 2019, around 2:30 on June 28, 2019, the Defendant, at the Defendant’s residence in Michuhol-gu Incheon, sold the Plaintiff’s horses at the price with a bar bar (1m in length) which is a dangerous and dangerous article when the Plaintiff was dissatisfied with the Plaintiff at the time, and sustained the Plaintiff’s tear.

B. The Defendant was indicted for committing a special injury by the Incheon District Court 2019 High Order 4614 with respect to the tort described in the above paragraph (a) (hereinafter “instant tort”), and was sentenced to a conviction of eight months of imprisonment on October 23, 2019, and the Defendant appealed, but the appeal was dismissed, and the said judgment became final and conclusive.

2. Determination

A. According to the facts of the above recognition that liability for damages occurred, the defendant committed the tort of this case in which the defendant injured the plaintiff as dangerous articles on June 28, 2019, and thus, the defendant is liable to compensate for the damages suffered by the plaintiff.

B. In the instant complaint, the Plaintiff sought payment of consolation money of KRW 30,00,000 and KRW 30,000,100 among the medical expenses of KRW 30,000,00,000, the Plaintiff sought reimbursement of KRW 6,500,000 from September 29, 2020, the Plaintiff did not seek payment of consolation money of KRW 6,50,000 from the daily income of KRW 257,540, dental treatment expenses of emergency room, dental treatment expenses of KRW 2,520,00, and dental treatment expenses of KRW 11,40,00 (one time) in the future (one time), KRW 10,00,000,000 in total, KRW 30,67,540 in the medical expenses of KRW 10,00,000, KRW 200, 200, 200, 200, 200, 2000.

1) The Plaintiff is receiving KRW 3,500,000 from KRW 3,00,00 in one month while taking charge of beauty art at the shop.
