Defendant
A is a director at the site of a new construction project performed by Defendant B (hereinafter referred to as “B”), who manages the recruitment and use of his/her employees, work instructions, safety and health measures, etc. as a chief director at the site of a new construction project, and Defendant B is a company established for the purpose of construction business, etc.
1. Defendant A
(a) In the places where workers might fall down, as the end or opening part of the work launching and passage, the business owner shall install a strong structure with sufficient strength protection measures, such as safety railings, fences, vertical fall-off nets, or covers;
Nevertheless, on April 10, 2014, the Defendant did not take protective measures against each opening part of the said construction site on the 704 Dong (4-5 floor), 709 Dong (5-6 floor), 710 Dong (4-5 floor), 702 Dong (the interval between the pit pumps and the structure, and between E/V 6 floor E/V base), 704 Dong (the 4th floor, between the pit pumps and the structure, and the 4th floor stairs), 709 Dong (the 1st floor stairs).
(b) The business owner shall protect his/her employees from a closed external structure so that they may not be exposed to the charging part of the charging part of electric machinery, apparatus, or street, etc., which is in danger of electric shock, by having contacted or approaching the charging part of electric machinery, apparatus, or street, etc. due to work or passage;

Nevertheless, on April 10, 2014, the Defendant installed a protective dog on the front of the underground water tank and the first floor of the underground parking lot in the construction site.
