1. The defendant shall be the plaintiff.
(a) to deliver the land listed in the separate sheet and to indicate the annexed drawing in the land above;
1. Facts of recognition;
A. On February 3, 2006, the Plaintiff completed the registration of ownership transfer based on sale on November 21, 2005 with respect to the land listed in the separate sheet (hereinafter “instant land”).
나. 원고는 남편인 C를 통해 피고로 하여금 2008.경 내지 2009.경부터 이 사건 토지 및 위 지상 별지 도면표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차로 연결한 선내 주택 약 64㎡ 및 같은 도면표시 ㉤, ㉥, ㉦, ㉧, ㉤의 각 점을 순차로 연결한 선내 창고 약 32㎡(위 주택 및 창고를 이하 ‘이 사건 건물’이라 한다)를 점유, 사용하도록 하였는데, 2015. 8.경 피고와 사이에 이 사건 토지 및 이 사건 건물에 관하여, 피고가 원고에게 2015. 8. 1.부터 매월 40만 원의 월 임료를 지급하고서 이를 임차하기로 하는 내용의 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였다.
C. However, from August 1, 2015 to May 31, 2017, the Defendant paid to the Plaintiff KRW 6.45 million out of KRW 8.8 million, the sum of monthly rent for the period from August 1, 2015 to May 31, 2017, and did not pay KRW 2.35 million equivalent to the monthly rent for about six months.
On June 8, 2017, the Plaintiff sent to the Defendant a certificate that the instant lease contract is terminated on the grounds of the delinquency in payment of the monthly rent, and around that time, the said certificate reaches the Defendant.

2. Judgment on the parties' arguments
A. According to the above findings of the determination as to the cause of the claim, the instant lease agreement was lawfully terminated by the Plaintiff’s declaration of termination on the ground of overdue delay in rent.
Therefore, the Defendant is obligated to deliver the instant land and the instant building to the Plaintiff, and due to the payment of the overdue rent or the return of unjust enrichment equivalent to the overdue rent, 2.35 million won in arrears until May 31, 2017, and the instant case.
