The prosecution of this case is dismissed.
Reasons
1. At around 03:10 on January 21, 2013, the Defendant: (a) assaulted the victim two times on the hand floor on the grounds that the Defendant asked the route to the victim D, “Isle”, and the victim expressed bad faith.
2. The above facts charged are crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(3) of the Criminal Act. Since the victim expressed his/her wish not to punish the defendant on February 26, 2013, which was after the institution of the instant indictment, the prosecution of this case is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
