A. On August 2, 2015, the Plaintiff and the Defendant agreed that the Defendant shall have construction business operators perform remodeling works with respect to the housing of 2nd floor in Daegu Suwon-gu C (hereinafter “instant housing”) under his/her own ownership, and that the Plaintiff shall arrange for and supervise the construction business operators, and the Defendant shall pay the Plaintiff the labor cost during the remodeling work period.

The Plaintiff spent KRW 52,103,200 as construction materials on behalf of the Defendant in mediating, managing, and supervising the instant remodeling project. Since the Defendant only paid KRW 43,00,000 among them, the Plaintiff is obligated to pay KRW 8,230,870 as well as the labor cost of KRW 12,00,000 as well as KRW 20,230,870 as well as KRW 12,00 as the labor cost of the Plaintiff and the Director of the Field.

B. As to the Defendant, the Defendant contracted to the Plaintiff for remodeling construction of the instant housing in KRW 50,000,000, and paid KRW 49,600,000 to the construction cost, the Defendant asserted that it cannot comply with the Plaintiff’s claim.

2. Determination as to the cause of action

A. 1) The Defendant requested several places in order to implement the remodeling project on the instant housing with the construction cost of KRW 50 million, and all this amount could not be performed as desired by the Defendant. 2) The Defendant, upon introduction of the Plaintiff, changed the part of the construction of the instant remodeling project, which was originally intended to be entrusted to the instant remodeling project, while the Plaintiff continued the remodeling project by purchasing the materials of the instant remodeling project to cause the construction business operator to perform the construction project.

3) The Plaintiff paid KRW 51,120,40,00 in total, as indicated in the attached Form, to D, a site manager, including the payment of KRW 4,305,70,00 in the material cost and detailed construction cost of the instant remodeling project (other than the Plaintiff’s on-site expenses (food, material cost) for the Plaintiff’s assertion.
