A, Defendant B, and Defendant C jointly operated penta with the trade name of “E” in the sports Pyeong-gun D et al.
1. Violation of the Building Act;
(a) A person who intends to change the use of a building, the use of which has been approved for the change of use of which has been permitted, to the upper Gun shall obtain permission from the competent authorities;
The Defendants conspired to obtain permission from the competent authority on February 2, 2017 to July 19, 2017, the Defendants changed the use of a total of 1,561.41 square meters for a higher military person’s accommodation to a higher military person’s business facility, including the use of a multi-family house of 112.46 square meters and 5.08 square meters for a third-story multi-family house of 112.46 square meters as a unit for a higher military person’s business facility, and the use of a multi-family house of 1,561.41 square meters for a higher military person’s accommodation as indicated in the list of crimes in the attached Table.
(b) A report shall be filed with the competent authority to extend, remodel, or rebuild the area of an extension not exceeding 85 square meters in total;
On February 2017, the Defendants conspired and did not report to the competent authority, and extended the office of 60.4 square meters on the Gyeonggi-gun F, Gyeonggi-do, and one parcel B, which is a planned control area, to 60.4 square meters, and the office of 16 square meters on the 16th floor of Gyeonggi-gu, Gyeonggi-do, which is a planned control area, on June 2017.
2. Any person who intends to conduct public sanitary business in violation of the Public Health Control Act shall report it to the competent authority;
The Defendants conspired to report to the competent authorities without reporting, and operated accommodation business with 370,000 to 770,000 won per day using 11 guest rooms equipped with beds, bathing rooms, cooking facilities, etc. so that customers can sleep and stay in the above period and place.
