Defendant
A shall be punished by a fine of 6 million won, and Defendant B shall be punished by a fine of 4 million won.
The above fines are imposed by the Defendants.
Punishment of the crime
1. Although Defendant A was prohibited from having any real right to real estate registered under the name of the title trustee in accordance with the title trust agreement, the Defendant had had his/her husband registered the real right to real estate in the name of the title trustee on September 201, in transferring the Gangnam-gu Seoul E apartment 101 Dong 504 (hereinafter “E apartment”) owned by his/her female to avoid the payment of capital gains tax on two houses owned by one household in the transfer of the E apartment, Gangnam-gu Seoul, Seoul, 101 Dong 504 (hereinafter “E apartment”).
Accordingly, on September 16, 201, the Defendant entered into a real estate sales agreement with the said G purchaser with respect to the said F Housing according to the title trust agreement entered into with the said G through a mother of G on September 16, 201, and had the said G submit documents related to the registration of ownership transfer through an irregular certified judicial scrivener, and completed the registration of ownership transfer based on sale in the name of the said G on September 21, 201.
2. Although Defendant B did not assist and abetting a title trustee to register a real right to real estate under the name of the title trustee pursuant to the title trust agreement, the Defendant entered into a title trust agreement with the former “F housing” upon the request of the title trustee, according to the delegation of the mother of G, and entered into a title trust agreement with the former “F housing” in the name of G, and agreed to transfer the ownership thereof.
Accordingly, on September 16, 201, the Defendant entered into a real estate sales contract with the said G as the purchaser of the said F Housing on behalf of the said G, and on September 21, 201, completed the registration of ownership transfer for the reason of sale under the said G’s name, and registered the title transfer for the said G in title trust to G.
