1. On the Plaintiff (Counterclaim Defendant),
A. Defendant B received KRW 59,000,000 from the Plaintiff (Counterclaim Defendant) at the same time.
1. Basic facts
A. On August 5, 2008, the Plaintiff issued to H a power of proxy (hereinafter “instant power of proxy”) to enter into a lease agreement (on a deposit basis, monthly rent, down payment, and monthly rent deposit (on a deposit basis: H bank J in the name of H; hereinafter “instant account”) related to the housing listed in the attached Table 1 (hereinafter “instant housing”) owned by the Plaintiff, with the power of proxy (hereinafter “instant power of attorney”).
B. H, while operating an O Licensed Real Estate Agent Office (P, L, and P) with a licensed real estate agent’s license lent from N, verified that the instant power of attorney and the Plaintiff’s personal seal impression were possessed by the Defendants, who are parties to the contract, directly or through Q or N, and confirmed that they had a power of attorney, and entered into a lease agreement with respect to the instant housing on behalf of the Plaintiff as follows, and transferred the leased object.
However, H falsely reported that the Plaintiff entered into a lease contract with the same content as the attached list 3.
1) On March 10, 2014, Defendant B and the instant housing, concluded a lease agreement with the term from March 22, 2014 to March 21, 2015 on the lease deposit amounting to KRW 59 million, and the term of lease from March 22, 2014 to March 21, 2015, and paid KRW 4 million to the instant account on two occasions, respectively. (2) On February 14, 2015, Defendant C and the instant housing, concluded a lease agreement with the term of February 21, 2015 to receive KRW 30 million from February 21, 2015 to February 21, 2016.
3. On March 24, 2009, Defendant D and the instant housing amounting to KRW 26 million for the lease deposit and the term of lease from April 24, 2009 to April 23, 2010, respectively, enter into a lease contract with the term of lease from April 24, 2009, and one million won for the down payment shall be KRW 25 million for cash and remainder at the time of entering into the contract.
