There is an error of law affecting the judgment by misunderstanding facts.

2. Determination

A. According to the evidence duly adopted and examined by the court below, the following facts can be acknowledged.

1) From July 1, 2013 to June 30, 2015, the Defendant served as the Gangwon-si apartment management warden, and the victim is a person elected as the president of the 4th meeting of occupants of the said apartment complex on May 2015.
