1. 원고의 주장 전남 해남군 C 대 245㎡(이하 ‘이 사건 토지’라 한다) 중 별지 도면 표시 , , , , , ¹, ¹, ¹, ¹, ¹, ¹, ¹, ¹, ²의 각 점을 차례로 연결한 선내 (나) 부분 136㎡ 지상 단층 블록건물(주택), 같은 도면 표시 ¹, ¹, ¹, ¹, ¹, ¹의 각 점을 차례로 연결한 선내 (다) 부분 13㎡ 지상 단층 블록건물(창고 및 부엌), 같은 도면 표시 ¹, ¹, ¹, ¹, ¹, ¹, ¹의 각 점을 차례로 연결한 선내 (라) 부분 31㎡ 지상 단층 슬라브(화장실 및 보일러실)은 미등기건물(이하 ‘이 사건 건물’이라 한다)로 원고는 2016. 11. 18. 이 사건 건물의 부지인 이 사건 토지에 관하여 소유권이전등기를 마쳤다.
At the time when the Plaintiff completed the registration of ownership transfer with respect to the instant land, he/she was residing in the instant building owned by D. However, around July 2017, the Plaintiff acquired ownership by acquiring the instant building from D without compensation, and had D continue to reside in the instant building without compensation.
After that, D died, and the defendant is the heir of D.
Therefore, the defendant is obligated to leave the building of this case to the plaintiff.
2. On the premise that the Plaintiff is the owner of the instant building, the Plaintiff sought removal from the instant building on the premise that the Plaintiff is the owner of the instant building.
However, Article 186 of the Korean Civil Code provides that the acquisition, loss, and change of real right by a juristic act on real property takes effect by registering the acquisition, loss, and change of real right on real property.
