2. The costs of lawsuit shall be borne by the Plaintiff.

A. On March 8, 2013, the Defendant entered into a loan agreement with the agricultural company B Co., Ltd. (hereinafter “B”) to provide loans of KRW 3.5 billion by specifying the Defendant’s purpose of using the loans only for the remaining money business (hereinafter “instant loan agreement”). The Defendant was granted a security right on the instant pigs 7,670 (hereinafter “the instant pigs”).

B. B, upon entering into the instant loan agreement, submitted to the Defendant a lease agreement concluded on February 5, 2013 between B and the Plaintiff on the basis of the materials of rent for the farm site and facilities, which will be required for the operation of the two kinds of money business in the future. According to such agreement, B entered into a lease agreement between the Plaintiff and the Plaintiff, setting the lease term as KRW 60 months from February 5, 2013, and KRW 70 million from rent monthly (hereinafter “instant lease agreement”).

C. On December 5, 2013, the Plaintiff executed the seizure of corporeal movables in relation to the pigs of this case, with the title of execution of a notarial deed on the face value of KRW 160 million and each promissory note causing KRW 200 million (hereinafter “each promissory note of this case”) issued by the Daejeon District Court (Seoul District Court Branch Branch Office 634, 2013No. 635).

On the other hand, the Defendant carried out pigs of 1,905 1,905 on three occasions on December 6, 2013 and December 27, 2013 through B without knowing that the seizure of corporeal movables was executed.

E. The Plaintiff filed a complaint with the competent police station against the representative director and manager of B on the charge of nullifying an indication of goods stored in the line of duty, and the Defendant filed a lawsuit of demurrer against the third party in the Daejeon District Court for the reason that the right of transfer was established on the instant pigs.
