1. The instant lawsuit was concluded on January 19, 201 as the withdrawal of the lawsuit.
2. The Plaintiff’s litigation costs after the completion of the lawsuit.
If a person who has raised an objection to a distribution schedule fails to appear on the first date for pleading of a lawsuit of demurrer against distribution (Article 158 of the Civil Execution Act), the said lawsuit shall be deemed to have been withdrawn (Article 158 of the Civil Execution Act), and the fact that the Plaintiff did not appear on the first date for pleading opened in the court of law No. 327 of this Court on January 19, 2017, even after receiving the notification of legitimate date after the Plaintiff filed a lawsuit of demurrer against distribution of this case, is apparent in the record. Thus, the instant lawsuit was withdrawn on January 19, 2017
Nevertheless, since the Plaintiff submitted an application for designation and submitted an application for designation and made it unclear the litigation relationship, it is so decided as per Disposition in order to clarify the termination of the lawsuit in this case.
