The Plaintiff’s partial dismissal claims for damages for delay calculated at the rate of 15% per annum from December 31, 2011 to the date of full payment, but the interest rate under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings applies from the day following the day on which the complaint was served on the obligor. As such, the Plaintiff’s claim for damages for delay from December 31, 201 to December 3, 2018, which is the delivery date of a duplicate of the complaint of this case, shall be dismissed only for the portion exceeding five percent per annum, which is the statutory interest rate under the Civil Act.
