The prosecution of this case is dismissed.
At around 10:10 on November 28, 2012, the Defendant assaulted the victim’s head, frighting over the ground floor on the ground that the victim C (here, 47 years of age) who contracted with the bamboo in the bamboo paddy field owned by Jinju-si, located in Jinju-si, and that the bamboo with no product value was dead.
Judgment
The facts charged of this case are crimes falling under Article 260 (1) of the Criminal Act, which cannot be prosecuted against the victim's express intent under Article 260 (3) of the same Act. According to the agreement submitted to this court, the victim can be acknowledged the facts that the victim expressed his/her intention not to punish the defendant. Thus, the prosecution of this case is dismissed in accordance with Article 327 (6) of the Criminal Procedure Act.
