1. The Defendant: (a) KRW 51,267,300 and the Plaintiff’s annual rate from December 16, 2018 to May 9, 2019; and (b) May 10, 201.
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. The provisions pertaining to statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings on Partial Dismissals (hereinafter “Promotion Act”) were amended and promulgated on May 21, 2019 and enforced from June 1, 2019, and 15% per annum, which is the statutory interest rate under the previous Promotion Act, was applied during the period from May 31, 2019, but the statutory interest rate under the Promotion Act was changed to 12% per annum from June 1, 2019.
Therefore, the damages for delay calculated at the rate of 12% per annum from June 1, 2019 to the date of full payment shall be recognized, and the excess portion shall be dismissed.
