The court may decide not to adopt the application for examination of evidence when it deems it unnecessary at the discretion of the court (see, e.g., Supreme Court Decision 2010Do7947, Jan. 27, 201). Thus, the court below rejected the defendant's application for examination of evidence.

Even if it is illegal, it cannot be said that it is illegal.

Other grounds of appeal shall not fall under legitimate grounds of appeal prescribed in Article 383 of the Criminal Procedure Act.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
