A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Punishment of the crime
[Fact-finding] The Defendant is a person who entered the Republic of Korea with a visa (H-2-5) that is issued only to Korean nationals in the Chinese and old training region, despite that the Defendant’s foreigner with the Republic of Korea’s nationality was not a descendants of Korea around January 21, 2016.
The Defendant, with the knowledge of the fact that it is difficult to enter the Republic of Korea for the purpose of job-seeking activities, knew of the fact that it is difficult to enter the Republic of Korea by normal means, sought a specific explanation of the method and plan to obtain a false visa from the Republic of Korea, and first, upon paying USD 8,600 to “D”, the Defendant agreed to pay USD 16,000 to “C” after entering the Republic of Korea for money through job-seeking activities, to obtain a visa of employment (H2-5) visiting the Republic of Korea by visiting the Republic of Korea (H-2-5) through “D”).
[2] No person may apply for a false visa or visa issuance certificate to allow an alien to enter the Republic of Korea.
On December 30, 2015, at the Embassy of the Republic of Korea, the Defendant was issued a visa (H-2-5) for visiting Korea only to Korean nationals in Chinese and old training regions by filing an application for a visa with a false birth certificate, which is forged as a son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son's son.
Accordingly, the Defendant applied for a visa by deceptive scheme at the same time as interfering with the legitimate performance of duties by public officials in charge of issuing visas belonging to the Embassy of the Republic of Korea.
