1. 공무집행방해 피고인은 2020. 7. 24. 03:25경 서울 구로구 B 부근 노상에서, ‘피고인이 택시 요금을 내지 않고 경찰을 불러 달라고 한다’는 취지의 112신고를 받고 현장에 출동한 서울구로경찰서 C파출소 소속 경장 D, 경장 E으로부터 무임승차로 통고처분을 받은 다음 위 경찰관들이 순찰차를 타고 복귀하려고 하자 갑자기 위 순찰자의 뒷문을 열고 뒷좌석에 탑승한 후 “내가 뭘 잘못했냐, 경찰서에 가자.”라고 소리를 쳐 이에 위 경장 D과 경장 E이 하차시켰다.

이에 피고인은 양손으로 위 경장 D의 양 손목을 강하게 움켜쥔 다음 오른손으로 경장 D의 가슴 부위를 1회 밀치고, 이를 위 경장 E이 제지하려고 하자 손으로 경장 E의 가슴 부위를 1회 밀쳐 경찰관들을 각 폭행하였다.
