1. All the claims of the plaintiff and the plaintiff succeeding intervenor are dismissed.
2. The costs of the lawsuit are assessed against the plaintiff and the succeeding intervenor.
Reasons
The Plaintiff and the Plaintiff’s succeeding intervenor asserted that the sum of principal and interest that the Plaintiff loaned to B as an entertainment tavern operating fund is KRW 41,332,192 (principal principal KRW 27 million) as of April 30, 209, and the Defendant is a joint and several surety for the above loan obligation.
However, there is no evidence supporting the defendant's joint and several liability, and it is inevitable to dismiss all the claims of the plaintiff and the succeeding intervenor.
